Terms of Service

These terms govern your use of Benchside. For enterprise customers, a signed master agreement (MSA) takes precedence over these terms where the two differ.

01Agreement

By accessing or using Benchside, you agree to these terms on behalf of yourself and the organization you represent. If you do not agree, do not use the service.

02The service

Benchside generates analysis to help you evaluate technology vendors and proposals. The outputs are decision-support material, not legal, financial, or professional advice. You are responsible for your own decisions and for validating outputs before relying on them.

03Accounts and acceptable use

You agree to keep your credentials secure and to use the service lawfully. You agree not to:

  • attempt to access another organization’s data;
  • probe, scan, or test the security of the service without written permission;
  • reverse engineer, scrape, or resell the service;
  • upload unlawful content or content you have no right to submit.

04Your content

You retain all rights to the content you submit and to the outputs generated for you. You grant us a limited license to process that content solely to provide the service. We do not use your content to train third-party models.

05Plans, billing, and trials

Paid plans are billed in advance on the cadence shown at checkout. Trials convert or expire as described at sign-up. Fees are non-refundable except where required by law or stated in a signed agreement. Enterprise terms, including invoicing, are handled in the MSA.

06Availability

We work to keep the service available and will publish status and incident information. Specific uptime commitments, where offered, are defined in an enterprise service level agreement.

07Disclaimers and liability

The service is provided “as is.” To the maximum extent permitted by law, we disclaim implied warranties, and our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

08Termination

You may stop using the service at any time. We may suspend or terminate access for material breach of these terms. On termination, you may export your data for a limited window before deletion.

09Changes and contact

We may update these terms and will post changes here. Continued use after changes means you accept them. Questions: legal@benchside.ai.

Customers can get emailed when our Terms or Privacy Policy materially change - turn it on in Settings → Notifications.
